Terms of Service

These Terms of Service ("Terms") govern your use of the dockup.ai platform operated by ADACOMP LLC ("Dockup", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our platform, you confirm that you are at least 16 years old, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations.

2. Description of Services

Dockup provides a cloud deployment platform that enables users to build, deploy, and manage applications and databases. Our services include automated deployment pipelines, managed databases, SSL provisioning, and related infrastructure tools.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use our platform to:

• Violate any applicable laws or regulations
• Host or distribute malware, phishing pages, or malicious content
• Engage in cryptocurrency mining without prior authorization
• Send unsolicited bulk communications (spam)
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the platform's infrastructure

We reserve the right to suspend or terminate your account and remove content that violates this policy without prior notice.

5. Pricing and Payment

Paid plans are billed monthly. Credits included in your subscription are valid for the billing period and do not roll over. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' notice.

6. Free Tier

Our free tier includes limited resources as described on our pricing page. We reserve the right to modify or discontinue the free tier at any time. Free tier deployments that remain inactive for 30 consecutive days may be automatically suspended.

7. Uptime and Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for damages resulting from service interruptions.

8. Your Content

You retain ownership of all code, data, and content you deploy on our platform. By using our services, you grant us a limited license to access, store, and process your content solely for the purpose of providing our services. We do not claim ownership of your intellectual property.

9. Data and Backups

While we provide automated backup features for managed databases, you are ultimately responsible for maintaining your own backups. We recommend regularly exporting critical data. We are not liable for data loss resulting from hardware failures, software bugs, or account termination.

10. Limitation of Liability

To the maximum extent permitted by law, ADACOMP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ADACOMP LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our platform, your content, or your violation of these Terms.

12. Termination

You may terminate your account at any time through your dashboard settings. Upon termination, your deployments will be shut down and your data will be deleted within 30 days. We may terminate your account for violation of these Terms or for any reason with 30 days' notice.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York County, New York.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms.
